Transitional Support

Transitional support helps the lower-earning spouse gain education or training to reenter or advance in the workforce. It’s typically short-term. Because courts can only make modifications retroactive to the date the petition was filed, acting promptly matters.

Under Oregon law, spousal support doesn’t automatically terminate when the receiving spouse remarries. The court instead considers the extent to which the new marriage has improved that spouse’s economic situation before deciding whether to modify the award. Cohabitation with another person may also be a basis to seek modification, depending on the circumstances.

Can Alimony Be Enforced?

Spousal support is a court-ordered obligation. If the paying spouse fails to comply, the other spouse can return to court to enforce the order. The court may hold the non-compliant spouse in contempt, which can result in fines or jail time. The court may also garnish the paying spouse’s wages, automatically deducting support payments from each paycheck and forwarding them to the receiving spouse.
